Terms of Service

General conditions that regulate access to and use of the professional audio and video recording platform of PodSync Spain. By using the service, you fully accept these conditions.

A contract between the creator and the platform

PodSync Spain provides audio and video capture tools for remote recordings. These terms establish the rules of the service: what you agree to upon entering, what you can and cannot record, who owns the content you produce, and what responsibility the platform has in the event of technical interruptions.

We recommend reading the full document before starting your first session. If you do not agree with any condition, do not use the service. For specific questions, you can write toour contact team.

Acceptance of conditions

Access to PodSync and the use of its recording tools implies full acceptance of these terms by the user. If you do not agree with any of the clauses set forth herein, you must refrain from using the service.

These terms constitute a legal contract between the user—whether as a host or guest of a session—and PodSync España S.L. as the platform operator, for the provision of digital multimedia content capture services. Acceptance occurs the moment you start a recording session, create an account, or access any of the platform's tools.

If a participant is invited to a session without having created their own account, the acceptance of these terms falls to the host of the recording. We recommend informing all session participants about the nature of the platform before starting the capture.

Lawful use and user responsibility

You agree to use the platform lawfully, without engaging in activities that may damage PodSync's infrastructure or the rights of third parties. Recording content that violates current law or does not have the express consent of all session participants is prohibited.

You are solely responsible for the recorded content and the use you make of the files downloaded from our servers after the service ends. This includes the storage, distribution, publication, and any transformation of the recordings once you have downloaded them.

In particular, prohibited uses of the service include: attempting to access other users' systems or accounts without authorization, introducing malicious software or code designed to interfere with the platform, recording people without their consent, and using the infrastructure for activities that infringe upon personal data protection regulations.

PodSync reserves the right to suspend sessions or accounts when it detects activity that may compromise the integrity of the service or other users. This suspension will be communicated, whenever possible, to the email address associated with the account.

Intellectual property and content rights

PodSync does not claim ownership of the audio or video files generated by users through its platform. The intellectual property of the recordings belongs entirely to the creator or the parties agreed upon in the user's production contract.

The platform acts as a capture tool: it provides the technical infrastructure for remote participants to record their local tracks in high fidelity. The content that originates from that capture is yours. We do not publish it, distribute it, or assign it to third parties.

However, you guarantee that you possess all necessary rights to make the recordings and indemnify PodSync against any claims related to copyright infringement in the captured content. If a third party claims rights over a file recorded through the platform, the responsibility lies exclusively with the user who initiated the session.

The code, design, brand, and technical elements of the PodSync Spain interface are the property of the operator and are protected by the intellectual property regulations applicable in Spain.

Technical limitation of liability

Given the technical nature of internet-based services, PodSync cannot guarantee the absolute absence of errors or interruptions in the service, although we implement engineering practices to reduce them to a minimum.

We are not responsible for data loss resulting from failures in the user's hardware, problems with the local internet provider, or misuse of the browser. The platform records local tracks on each participant's device; if a device fails during the session, the corresponding track may not be completed.

It is recommended to perform tests prior to critical recordings to ensure the compatibility of the user's environment: verify network connection, close applications that consume bandwidth, confirm microphone and camera permissions in the browser, and use tested audio equipment. For particularly sensitive sessions, it is advisable to have a backup plan or a second capture source.

The generated files remain available for download for a limited period after the session. After that period, PodSync does not guarantee the retention of recordings on its servers. It is the user's responsibility to download and archive their files within a reasonable timeframe.

Modifications and termination of the service

PodSync reserves the right to modify, suspend, or discontinue the service—or any part of it—at any time, with prior notice to registered users whenever possible. Substantial modifications to these terms will be communicated by email to the account associated with the profile before they take effect.

In the event of a breach of these terms by the user, we reserve the right to cancel their account and access to the platform immediately. This cancellation may occur without prior notice when the breach affects the security, integrity, or availability of the service.

Termination of the service does not exempt the user from their outstanding payment obligations or from responsibilities derived from their previous use of the service. After cancellation, undownloaded files will be deleted from the servers according to the established retention cycle.

The user may request the deletion of their account at any time. The request is processed through the support email, and the deletion of personal data is carried out in accordance with the provisions of thePrivacy Policy.

Applicable law and jurisdiction

These terms are governed by Spanish law. For any dispute that may arise from the access or use of the platform, the user and PodSync agree to submit to the courts and tribunals of the city of residence of the service operator, waiving any other jurisdiction that may correspond to them.

The partial invalidity of any of these conditions will not affect the validity of the rest, which will remain in full force for both contracting parties. If a clause is found to be unenforceable, it will be interpreted as closely as possible to the original intention within the current legal framework.
